1. Agreement to these terms
Orbil is a personal book library, reading tracker, and reading journal app provided by Prometeuz ("Prometeuz", "we", "us", or "our"), based in Cauayan City, Isabela, Philippines.
These Terms of Use (the "Terms") govern your use of the Orbil mobile app and the orbilshelf.com website (together, the "Service"). By downloading, installing, or using Orbil, you agree to these Terms. If you do not agree, please do not use the Service.
Our Privacy Policy explains how we handle your information and forms part of these Terms.
2. Who can use Orbil
You must be at least 13 years old to use Orbil. If you are under 18, or under the age of majority where you live, you may use Orbil only with the involvement and permission of a parent or guardian, who agrees to these Terms on your behalf.
You also confirm that you are not barred from using the Service under the laws of your country.
3. Your licence to use Orbil
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Orbil on devices you own or control, for your own personal, non-commercial use, in line with these Terms and the rules of the app store you downloaded it from.
We keep all rights we do not expressly grant you. Orbil, its name, logo, design, artwork, shelf decorations, and software are owned by Prometeuz and protected by intellectual property law.
4. Accounts
An account is optional. Orbil works fully offline without one. You only need an account if you own Orbil Plus and want to use cloud sync.
If you create an account, you agree to:
- Give accurate information and keep it up to date;
- Keep your password and sign-in credentials confidential, and not share your account with others;
- Take responsibility for activity that happens under your account;
- Tell us promptly at support@prometeuz.com if you believe your account has been accessed without permission.
You can sign out at any time, and you can ask us to delete your account as described in our Privacy Policy.
5. The free version and its limits
Orbil is free to download and includes everything you need to start organising your reading life. The free version has some limits:
- Up to 50 books in your library;
- Up to 6 tags;
- Storage on your device only, with no cloud sync or cloud backup;
- A selected set of shelf styles and decorations, with the rest reserved for Orbil Plus.
When you reach a limit, Orbil will let you know and offer Orbil Plus. Your existing data stays intact and fully usable.
We may adjust these limits as the app develops. If we materially reduce what the free version offers, we will give notice in the app first, and we will not delete content you have already saved.
6. Orbil Plus
Orbil Plus is a one-time purchase, not a subscription. There is no recurring charge and nothing auto-renews. It unlocks an unlimited library and tags, cloud sync and backup, the full set of shelf styles and decorations, and expanded insights.
Orbil Plus is purchased through the app store on your device and is tied to the store account you bought it with. You can reinstall Orbil and use Restore Purchases to get it back on any device signed in to that same store account.
To use cloud sync, you must sign in to an Orbil account so the purchase can be linked to it. A single Orbil Plus purchase can be linked to one Orbil account. If a purchase is already linked to a different Orbil account, Orbil will tell you, and you will need to sign in to that account or contact support. This prevents one purchase from being shared across unrelated accounts.
Cloud sync needs an internet connection and depends on services we do not control. We aim to keep it reliable, but we cannot guarantee that it will always be available or instant.
7. Payments, refunds, and prices
All payments for Orbil Plus and any other in-app items are processed by the app store on your device. We never see or store your payment details.
Refunds are handled by the app store, not by us. We are not able to issue refunds directly. To request one, use the app store's own refund process — for Apple, through reportaproblem.apple.com. If you believe you were charged in error, write to us and we will try to help you resolve it with the store.
Prices may change in the future. A price change never affects a purchase you have already completed: if you have already bought Orbil Plus, you keep it at no further cost.
Digital items such as shelf styles and decorations are cosmetic, do not expire, and have no monetary value. They cannot be exchanged, transferred between accounts, or converted to cash.
8. Your content stays yours
Everything you create in Orbil — your notes, thoughts, personal summaries, quotes you save, vocabulary entries, tags, collections, photos you take, and the details you enter about your books — belongs to you. We claim no ownership of it.
To operate the Service, you grant us a limited, worldwide, royalty-free licence to store, copy, transmit, back up, and display your content solely so that Orbil can work for you — for example, to sync it between your devices. This licence exists only for running the Service and ends when you delete the content or your account, apart from copies inside routine backups until they are overwritten.
We will not publish your content, use it in marketing, or use it to train artificial intelligence models. We may use aggregated, anonymised statistics that cannot identify you or reveal your content — for example, how many users use a feature — to improve Orbil. If we ever want to feature something you created publicly, we will ask you first and only do it with your written permission.
You are responsible for keeping your own copies of anything important. Orbil's export feature lets you create a backup file at any time.
9. Acceptable use
When using Orbil, you agree not to:
- Break the law, or use Orbil to store or share unlawful, abusive, hateful, harassing, sexually exploitative, or infringing content;
- Upload images or text you do not have the right to use, including copyrighted cover art or excerpts beyond what fair use or fair dealing allows;
- Enter another person's personal information without a lawful reason. When you record who borrowed a book, keep it to what you genuinely need;
- Reverse engineer, decompile, or attempt to derive the source code of Orbil, except to the extent that applicable law expressly permits it;
- Circumvent, disable, or tamper with purchase verification, entitlement checks, free-version limits, or any security feature;
- Access the Service through automated means, scrape it, overload it, or probe it for vulnerabilities without our written permission;
- Attempt to access another user's account or data, or interfere with the Service's operation;
- Rent, resell, sublicense, or commercially exploit Orbil or any part of it.
If you find a security issue, please report it responsibly to support@prometeuz.com instead of exploiting or publishing it.
10. Quotes and copyright
Orbil is designed for saving short, personally meaningful passages for your own reference. You are responsible for the excerpts you save and for any quote image you export and share. Please keep excerpts short and appropriately attributed, and do not reproduce substantial portions of a copyrighted work.
If you are a rights holder and believe content shared from Orbil infringes your copyright, contact support@prometeuz.com with a description of the work, the material in question, your contact details, and a statement of your good-faith belief. We will review and act on valid notices.
11. Third-party content and services
Orbil uses third-party services to look up book details and to run accounts and cloud sync. Book information such as titles, authors, covers, publishers, and page counts comes from third-party sources and may be incomplete, outdated, or wrong. We do not warrant its accuracy — you can always correct it yourself in the app.
Links to external sites are provided for convenience. We do not control them and are not responsible for their content or practices.
12. Availability and changes to the Service
We may add, change, or remove features, and we may suspend the Service for maintenance, updates, or technical reasons. We do not guarantee uninterrupted or error-free operation.
Orbil is designed to work offline, and its core features — your library, reading sessions, notes, quotes, and statistics — do not need an internet connection. Barcode lookup, online book search, account sign-in, and cloud sync do.
If we ever decide to discontinue Orbil entirely, we will give reasonable notice and a way to export your data before the Service ends.
13. Suspension and termination
You may stop using Orbil at any time by deleting the app, and you may ask us to delete your account.
We may suspend or terminate your account or access to the Service if you materially breach these Terms — for example by tampering with purchase verification, attempting to access other users' data, using Orbil for unlawful content, or abusing our infrastructure. Where it is reasonable and lawful to do so, we will warn you first and give you a chance to put things right.
If we terminate your account, you keep any data stored on your own device, and you can export it. Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, and governing law — continue to apply.
14. Disclaimers
Orbil is a tool for personal organisation and reading tracking. It is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
In particular, we are not responsible for:
- Inaccurate book metadata supplied by third-party sources;
- Loss of data stored only on your device, including loss caused by deleting the app, device failure, theft, or a device reset. Please export backups regularly;
- Content you create or choose to store, including notes, quotes, images, and borrower details;
- Loans of physical books that you record in Orbil. Orbil simply keeps your notes about them; any arrangement is between you and the other person.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you. Nothing in these Terms removes consumer rights that cannot be waived under the law that applies to you.
15. Limitation of liability
To the maximum extent permitted by law, Prometeuz will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to your use of the Service.
Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for Orbil in the 12 months before the claim, or twenty United States dollars (USD 20).
These limits do not apply to liability that cannot be excluded by law, including liability for fraud, gross negligence, or wilful misconduct.
16. Indemnity
You agree to indemnify and hold Prometeuz harmless from claims, damages, and reasonable costs arising from content you store or share through Orbil, or from your breach of these Terms or of applicable law. This does not apply to the extent a claim results from our own act or omission.
17. Apple App Store terms
If you downloaded Orbil from the Apple App Store, the following applies:
- These Terms are between you and Prometeuz only, not with Apple. Apple is not responsible for Orbil or its content.
- Your licence to use Orbil is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for Orbil.
- If Orbil fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation for Orbil.
- Prometeuz, not Apple, is responsible for addressing any claim that Orbil or your use of it fails to conform to legal requirements, infringes intellectual property rights, or gives rise to product liability or consumer protection claims.
- You confirm that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country, and that you are not on any United States government restricted-parties list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law rules.
Please talk to us first. If you have a problem, email support@prometeuz.com and give us 30 days to resolve it. Most issues can be settled this way.
If a dispute cannot be resolved informally, you and Prometeuz agree to submit to the exclusive jurisdiction of the courts of Cauayan City, Isabela, Philippines. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer laws, or of the right to bring proceedings in the courts of your own country where the law gives you that right.
19. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and Prometeuz about the Service.
- Severability. If a provision is found unenforceable, the rest stays in force.
- No waiver. If we do not enforce a right, that is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.
- Language. These Terms are written in English, and the English version governs.
20. Changes to these Terms
We may update these Terms as Orbil changes. When we do, we will revise the "Last updated" date at the top of this page. If a change materially affects your rights, we will give notice in the app or by email before it takes effect. Continuing to use Orbil after that means you accept the updated Terms.
